A sneak peek of the life of a litigator and a behind the scene while representing claimants and defendants in commercial lawsuits, managing all phases of the litigation from the discovery through the pre-trial, pleadings, settlement, and appeal processes. The challenge during a legal dispute is knowing when to negotiate and when to litigate, in particular in Shareholders Disputes for reason that may vary (breach of contract, fiduciary misdeeds, disagreements over directions and liability). Should we sue to get the ruling, thinking we might be victorious? Or should we resolve the dispute, avoid expense and settle for an agreement without showing signs of weakness?

– The different forms of Alternative Dispute Resolution in the area of Corporate and Commercial Law (typically settled by an agreement between the parties but may also be heard and decided by a judge in court)
The workshop animated by Jackye Elombo, Dispute Resolution Partner, will aim at solving these questions in key points and putting into practice the Luxembourg case law.
The Workshop will last 3 hours, and it will be divided into a theoretical part (most common case-law and doctrine on Luxembourg Commercial Disputes,…) and a practical part, where the participants will solve a case study, enabling them to practice in a playful and interactive manner the theory learnt.
